Free + Fair develops and leads high-impact litigation to stop the advance of authoritarianism in the U.S. We are a 501c3 nonprofit organization that works completely pro bono.

The Landscape

Authoritarianism is ascendant in America.  We are experiencing an unrelenting assault on our rights, institutions, and the rule of law. With a shrinking Congress and a Cabinet of radically loyal appointees, the courts are the battleground. Constitutional litigation is one the last remaining guardrails preventing an irreversible, autocratic slide.


Meanwhile, many states are criminalizing books and bodily autonomy, while making it easier to carry guns, and harder to vote. Other local communities are enshrining personal freedoms into their laws and constitutions, and will need strong legal defense.


In the months and years ahead, our rights and our democracy will be won or lost in the courts.


How We Work

Free + Fair monitors federal and state legislation and executive action to identify authoritarian threats vulnerable to constitutional challenge. We select cases with the greatest potential to create nationally-significant case law to defeat these emerging threats. Then we leverage our national network to form talented teams that can prevail in these high-stakes, high-profile cases, and we provide senior leadership from inception through appeals up to the Supreme Court.


For most cases, we partner with pro bono teams at private law firms and other non-profit organizations. We can also handle cases independently.


This is our only work. Free + Fair does not participate in public advocacy, lobbying, research, or litigation that seeks individual, financial, or incremental results.
