THE IMPACT
The Court blocked DOGE’s effort to dismantle the federal government through mass firings — and quoted our brief in the first paragraph of its opinion. Now the case is before the Supreme Court.
THE BRIEF
In an emergency friend-of-the-court brief on behalf of 16 prominent Republican former public officials, we asked a San Francisco federal court to halt the dismantling of federal agencies by the “Department of Government Efficiency” in A.F.G.E. v. Trump — the most expansive and successful challenge against DOGE to date.
The following day, the Court blocked DOGE’s mass firings with a temporary restraining order, relying on our brief in the first paragraph of its opinion: “As a group of conservative former government officials have written to the Court: Unchecked Presidential power is not what the framers had in mind.”
In the brief and in additional filings before the U.S. Supreme Court, the conservative officials argue that the Trump administration’s unilateral actions to dismantle agencies and lay off workers violate the Constitutional separation of powers. “The constitutional genius of America is the establishment of the three branches of government that must cooperate with each other, and check and balance each other’s actions, to govern the country,” they write.
